Terms of Service

1. Acceptance of Terms

By accessing or using Figitize ("Service"), operated by RRG Figueroa, LLC ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Figitize is an AI-powered embroidery digitizing tool that converts uploaded images into embroidery machine file formats (PES, DST, JEF, EXP, HUS, VP3, XXX). The Service uses automated algorithms and artificial intelligence to generate stitch patterns. Files are generated algorithmically and are not manually reviewed by a human digitizer unless explicitly stated.

3. No Warranty — Use at Your Own Risk

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• Generated embroidery files will produce specific results on any embroidery machine
• Files will be compatible with every machine model or firmware version
• Stitch patterns will be free from errors, defects, or imperfections
• The Service will meet your specific quality requirements
• Generated files will not cause thread breaks, needle breaks, fabric damage, puckering, misalignment, or any other stitching issues

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RRG FIGUEROA, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Damage to embroidery machines, needles, or machine components
• Damage to fabric, garments, thread, or other materials
• Loss of business, revenue, or profits resulting from use of generated files
• Cost of substitute goods or services
• Any damages resulting from machine malfunction, misalignment, or improper operation related to files generated by our Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC FILE THAT GAVE RISE TO THE CLAIM.

5. User Responsibility

You acknowledge and agree that:

• You are solely responsible for testing all generated embroidery files on scrap fabric before production use
• You are responsible for selecting appropriate stabilizer, thread, needle, and machine settings for your specific fabric and machine
• Embroidery results depend on many factors outside our control including machine calibration, thread tension, fabric type, hooping technique, stabilizer selection, and environmental conditions
• You will verify file compatibility with your specific embroidery machine before use
• You assume all risk associated with using generated files on your embroidery machine

6. Recommended Best Practices

We strongly recommend that all users:

• Always perform a test stitch-out on scrap fabric before embroidering on final garments
• Use appropriate stabilizer for your fabric type
• Verify stitch count and design dimensions before loading to your machine
• Ensure your machine is properly maintained and calibrated
• Monitor the first stitch-out of any new design

7. Intellectual Property

You represent and warrant that you own or have the right to use any images you upload to the Service. You are solely responsible for ensuring that your uploaded designs do not infringe on any third-party copyrights, trademarks, or other intellectual property rights. We do not claim ownership of your uploaded images or the generated embroidery files. However, you grant us a limited license to process your uploaded images for the purpose of providing the Service.

8. Prohibited Uses

You may not use the Service to:

• Digitize copyrighted, trademarked, or licensed designs without proper authorization (including but not limited to sports team logos, brand logos, licensed characters)
• Generate files for illegal purposes
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Resell generated files as a digitizing service without disclosure that files are auto-generated

9. Payments and Refunds

All payments are processed through Stripe. Prices are in USD. By making a purchase you agree to Stripe's terms of service. Due to the digital nature of the product (embroidery files are delivered instantly upon payment), all sales are final. However, if a generated file is demonstrably corrupt or unreadable by the specified machine format, contact us and we will provide a replacement or refund at our discretion.

10. Service Availability

We do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue the Service at any time without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

11. Indemnification

You agree to indemnify, defend, and hold harmless RRG Figueroa, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Miami-Dade County, Florida.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting. Continued use of the Service after changes constitutes acceptance of the modified Terms.
